Brouse McDowell Announces Re-Election of Executive Committee Members & Managing Partner

Brouse McDowell, a leading regional business law firm, is pleased to announce the re-election of Daniel K. Glessner and Christopher F. Swing to the firm’s Executive Committee, as well as Marc B. Merklin to Managing Partner.

Elected for his fourth term on the Executive Committee, Dan Glessner is a partner in the Health Care practice group. He focuses on corporate and health care issues and serves the needs of various hospitals, physician group practices, dialysis centers, ancillary health care companies, and other health care entities. Dan provides counsel on a myriad of health care and corporate issues including joint ventures, mergers and acquisitions, long-term care, medical staff and licensure issues, employment, general contracting, implementation of policies and procedures, real estate transactions, Medicare, Medicaid and commercial payor audits and reimbursement issues, HIPAA, fraud and abuse, non-profit tax-exempt and managed care issues, contract negotiations, patient-related issues, and regulatory compliance concerns including fraud and abuse, Stark physician self-referral issues and the Anti-Kickback Statute, IRS compliance issues, private inurement/private benefit and various state law issues. In the continuing evolution of Health Care Reform, Dan and the Health Care practice group at Brouse McDowell ensure that health care clients are in compliance with all new and revised laws and help develop strategic models to respond to changes in the health care industry. Dan is certified by the Compliance Certification Board as a specialist in Healthcare Compliance. Prior to joining Brouse McDowell in 2008, he served as in-house counsel with the Akron General Health System for 16 years, and is retired as a Lieutenant Colonel from the United States Army Reserve with 28 years of service.

Serving his fourth term on the Executive Committee, Chris Swing is a partner in the Litigation practice group. Chris has 26 years of real estate, title insurance law, and litigation experience, with an emphasis on title insurance law and Closing Protection Letter (“CPL”) litigation. He represents a substantial array of publicly-traded corporations, closely-held businesses, landowners and developers. Chris counsels clients in controversies involving title insurance policies and CPLs, disputes concerning title and ownership of oil, gas, and mineral rights and interests, real estate development and zoning, construction, and business disputes. He routinely practices in federal and state courts, appearing before the U.S. Court of Appeals for the 6th Circuit, U.S. District Court, Northern District of Ohio, the Ohio Supreme Court and other Ohio appellate courts, the U.S. District Court, Southern District of Florida, and the U.S. District Court, District of Minnesota. Chris is AV® Preeminent™ Peer Review Rated through Martindale-Hubbell.

Brouse McDowell’s Executive Committee is comprised of five attorney members, including Marc B. Merklin, Managing Partner, Business Restructuring, Bankruptcy & Commercial Law practice group; Patricia A. Gajda, co-chair, Corporate & Securities practice group; and Daniel L. Silfani, co-chair, Corporate & Securities practice group.

Elected for this fourth term as Managing Partner, Marc Merklin is a member of the Business Restructuring, Bankruptcy and Commercial Law practice group and a member of the firm’s Executive Committee. He focuses on general business counseling, commercial law and business reorganizations. He represents creditors, debtors, committees and trustees in Chapter 11 reorganizations, as well as borrowers in loan transactions and bankruptcy and commercial litigation. Marc also works on the sale and acquisition of financially distressed companies. Marc is nationally Board Certified in Business Bankruptcy Law by the American Board of Certification, a nonprofit organization created to recognize attorneys who are experts in the bankruptcy and creditors’ rights fields.
