We help clients manage their ever-growing stores of documents and electronic information by developing and implementing records retention and information governance policies and assisting with the defensible disposition of information that is no longer needed or required. With the understanding that conducting business is our clients’ top priority and that much of our clients’ information is confidential or sensitive, we are able to take stock of information that never stops accumulating and help minimize the growth of those information stockpiles.

We perform audits to ensure that our clients’ information governance policies are followed and train employees on the mindful and appropriate creation, transmission, and storage of information.

We help our clients before and during litigation by investigating potential sources of relevant information, issuing and implementing information hold notices, identifying responsive information, and protecting privileged information from discovery.

Representative Information Management matters:

  • Assisted a major manufacturing client with revision of its document retention and litigation hold policies, including a review of the client’s litigation history and preservation obligations.
  • Developed and implemented a process for identifying privileged and trade secret information in responsive documents and redacting such information before the documents are produced in litigation.
  • Mapped the information sources within a client’s organization, identified the custodians of the client’s information, and documented the formats in which the information was stored.
  • Identified key custodians and established a process for collection of potentially responsive information in relation to ongoing serial litigation.
  • Drafted a litigation hold notice for a novel asbestos-related lawsuit against a manufacturer and tracked its employees’ responses and compliance.
  • Provided consultation to a manufacturing client who was implementing a new information system on the reporting functions needed for litigation purposes.
